Official Rules, Terms, Conditions & Release of Liability

Sponsor: Lifted Legends LLC (“Sponsor”). By purchasing merchandise, purchasing entries, participating in any promotion, giveaway, drawing, sweepstakes, contest, event, or accepting any prize offered by Lifted Legends LLC, you agree to all terms and conditions contained herein.

1. Eligibility

The Promotion is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age at the time of entry. Employees, contractors, affiliates, immediate family members, household members, officers, directors, agents, and representatives of Sponsor may be ineligible to participate. Void where prohibited, taxed, licensed, bonded, or otherwise restricted by law. Participants are solely responsible for ensuring their participation complies with all federal, state, and local laws.

2. Participant Responsibility

By entering, participant acknowledges that participant has read these Official Rules, understands these Official Rules, voluntarily agrees to be bound by these Official Rules, assumes all risks associated with participation, and accepts all Sponsor decisions as final. Sponsor reserves the right to interpret and enforce these rules at its sole discretion.

3. No Guarantee of Winning

Participation does not guarantee winning. Odds of winning depend on the total number of eligible entries received, eligibility verification, and compliance with all Official Rules. No representation or warranty is made regarding the probability of winning.

4. Entry Multipliers

Merchandise purchases may receive promotional entry multipliers, including but not limited to 10X Entries, 25X Entries, 50X Entries, or 100X Entries. Multipliers may change at any time without notice. Sponsor reserves the right to modify promotional multipliers at its sole discretion.

5. Direct Entry Packages

Sponsor may offer direct entry packages, including but not limited to $50, $100, $250, and $500 entry packages. Entry values may vary by promotion. Sponsor reserves the right to modify, suspend, discontinue, or replace entry packages at any time.

6. Vehicle Description

The prize vehicle is awarded “AS IS” and “WITH ALL FAULTS.” Sponsor makes no warranties including merchantability, fitness for a particular purpose, mechanical condition, cosmetic condition, future value, reliability, emissions compliance, or registration eligibility. Vehicle specifications, modifications, horsepower figures, accessories, photographs, videos, renderings, promotional materials, and descriptions are estimates only. Actual prize may differ.

7. Winner Selection

Winner shall be selected using a random drawing process. Sponsor reserves the right to verify eligibility, identity, age, residency, and compliance with all rules. Failure to satisfy any requirement may result in disqualification.

8. Winner Notification

Potential winner must respond within the time specified by Sponsor. Failure to respond may result in disqualification, selection of an alternate winner, or forfeiture of prize. Sponsor shall have no obligation to continue attempting contact.

9. Taxes

Winner is solely responsible for federal taxes, state taxes, local taxes, registration fees, licensing fees, insurance, transportation costs, title fees, and documentation fees. Sponsor shall not be responsible for any tax liability. Winner should consult a qualified tax professional.

10. Vehicle Transport

Winner is responsible for arranging transportation unless otherwise specified. Sponsor is not responsible for shipping delays, transportation damage, carrier negligence, storage costs, or pickup costs.

11. Release of Liability

Participant releases Lifted Legends LLC, owners, officers, directors, employees, agents, contractors, sponsors, vendors, and affiliates from any and all claims arising from participation, vehicle ownership, vehicle operation, prize acceptance, personal injury, property damage, death, financial losses, or emotional distress.

12. Assumption of Risk

Participant voluntarily assumes all risks associated with participation, travel, vehicle ownership, vehicle operation, vehicle modifications, and mechanical failures.

13. Publicity Release

Winner grants Sponsor the irrevocable right to use winner’s name, photograph, voice, likeness, social media content, and video footage for advertising and promotional purposes without additional compensation, unless prohibited by law.

14. Disqualification

Sponsor may disqualify any participant for fraud, misrepresentation, chargebacks, payment disputes, automated entries, identity manipulation, abuse of promotion rules, or violation of these Official Rules. Sponsor’s determination shall be final.

15. Fraud Prevention

Sponsor reserves the right to investigate IP addresses, payment methods, shipping addresses, email addresses, device fingerprints, and entry behavior. Fraudulent activity may result in entry cancellation, prize forfeiture, and permanent bans.

16. Chargeback Policy

Any participant initiating a chargeback may forfeit entries, forfeit prizes, and be disqualified from future promotions. Sponsor reserves all legal remedies available.

17. Limitation of Liability

In no event shall Sponsor’s liability exceed the amount actually paid by participant to Sponsor. Participant waives all claims for punitive damages, consequential damages, incidental damages, and lost profits.

18. Force Majeure

Sponsor shall not be liable for delays or cancellations resulting from acts of God, natural disasters, war, terrorism, government action, supply chain disruptions, internet outages, platform failures, payment processor issues, or other events outside Sponsor’s reasonable control.

19. Technical Failures

Sponsor is not responsible for website outages, server failures, payment processor issues, Stripe outages, browser incompatibilities, lost entries, failed submissions, or corrupted data.

20. Governing Law

These Official Rules shall be governed by the laws of the State of Wyoming without regard to conflict of law principles.

21. Arbitration

Any dispute shall be resolved through binding arbitration. Participant waives jury trial rights and class action participation to the fullest extent permitted by law.

22. Severability

If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.

23. Entire Agreement

These Official Rules constitute the entire agreement between participant and Sponsor regarding the Promotion.

24. Sponsor Rights

Sponsor reserves the right to modify, suspend, extend, cancel, terminate, or substitute prizes at any time, subject to applicable law.

25. Vehicle Value Disclaimer

Vehicle values advertised are estimates only. Actual market value may vary substantially. No cash equivalent is guaranteed unless expressly offered by Sponsor.

26. Winner Verification

Winner must provide government-issued identification, proof of residency, tax documentation, and any required affidavits or releases. Failure to provide requested documentation may result in disqualification.

27. State Restrictions

Residents of certain jurisdictions may be restricted or prohibited from participation. Participants are solely responsible for determining eligibility. The Promotion is intended for the 50 United States and District of Columbia only, subject to all applicable state-specific requirements and restrictions.

28. Sponsor Discretion

All Sponsor decisions are final, binding, and not subject to appeal.

29. Vehicle Modification Disclosure

Prize vehicle may contain aftermarket modifications. Modifications may affect warranty coverage, insurance availability, emissions compliance, and registration requirements. Participant accepts all risks.

30. Promotional Materials

Photographs, renderings, videos, and advertisements are for promotional purposes only. Actual prize may vary.

31. Data Collection

Participant consents to the collection and storage of name, address, phone number, email address, purchase history, entry history, device information, and related data for administrative, compliance, promotional, and fulfillment purposes.
